The main roof and the penthouse have concrete decks. All roof areas are sloped toward interior drains. 2. The existing roofing system was removed down to the vapor retarder which was attached to the concrete deck. 3. Tapered insulation was installed at the roof drains to provide a smooth transition from the field of the roof to the level of the roof drains. Flat polyisocyanurate and perlite board were installed in ribbons of cold adhesive. 4. New two-ply modified bitumen roof membrane and flashings were installed. The base sheet was installed with cold adhesive; the cap sheet was installed with a propane torch. New sheet metal edge, pitch pans, plumbing vent flashings and roof drain flashings were installed. All repairs and modifications to the Roofing System made after installation shall have been approved by Soprema; d Owner shall have given Soprema written notice within thirty days after any defect or leak is discovered or in the exercise of ordinary care should have been discovered; e. The completed installation of the Roofmg System shall have been inspected by an inspector authorized by Soprema and shall have been certified by him to be in conformity with Soprema's specifications; and f. The Owner shall have maintained the Roofing System by regularly removing all plants, vegetation, leaves, trash, and debris, and other foreign objects, keeping all drains unclogged and pmperly working at all times, preventing excessive traffic w:ross the roof, and maintaining pitch pans and flashing in a watertight condition. THIS LIMITED WARRANTY DOES NOT COVER AND SOPREMA SHALL NOT BE LIABLE FOR ANY LEAKS OR DEFECTS THAT RESULT FROM ANY OF THE FOLLOWING CONDITJONS OR EVENTS: a. Natural disasters and Acts of God, including, but not limited to, floods, lighttting, hurricanes, hail, tornadoes, windstorms in excess of Beaufort Number 8 of the Beaufort Seale, objects driven by wind, d~ or rain, earthquakes; b. Structural defects or failures, including, but not limited to, any defec~ fallure, or movement of any material underlying the roofing membrane or base flealting; c. Damage resulting from any installations on the roof or through the roof membrane; d Damage to the roof membrane caused by movement of metal work used in conjunction with the roof membrane; e. Repairs, modifications, or alterations to the roof membrane after completion unless done in a manner approved in writing by Soprema; f. Damage to the roof membrane caused by falling and blown objects; g. Damage to the roof membrane resulting from traffic across it's surface, it's use as a storage area or from any other similar cause; h. Damage to the roof membrane caused by the installation of a sprinkler system, water or air conditionin~ equipment, radio or television antenna, framework, sign, water tower, or other obJect or structure installed on the roof membrane without the prior written approval from Soprema of the methods, materials, and installation used; i. Damage caused by acciden~ fire, abuse, misuse, mistreatmen~ insect infestation, rodents, vermin, vandals, and improper or negligent maintenance; j. Damage caused by any leaks resulting from water infiltration from any portion of the building structure not a part of the Roofing System, chemical attack, or leaks resulting from negligent or improper building design, specification, or consbUction; k. Damage resulting from cbemieal attack ofthe Roofing System's products by exposure to chemicals including, but not limited to, chlorofluorocarbons, solvents, hydrocarbons. gasoliae, acids, corrosives, salts, turpentine, oil, fa~ grease, smoke, or fumes. In the event that any repairs are required, the expense of removing and replacing traffic surfaces or other structures built over the roof shall be borne by the Owner. This IJmlted Warranty is conditioned upon the Owner allowing Soprema and/or the Roofer free access to inspect the Roofing System during the term of this Limited. Warranty. Access to the Roofing System shall be allowed upon Soprema's reques~ on reasonable notice, and during daylight hours on weekdays. Soprema shall have no obligation to inspect the Roofing System at any time after issuing this Limited Warranty and shall have no liability for any failure to inspect the roof under any circumstances. In the event that Owner refuses to allow Soprema to inspeet the Roofing System or falls to maintain the Roofing System In accordanee with the conditions oftbls Limited Warranty, all further obllgadons of Soprema under this Limited Warranty, Including any obllgadons to repair leaks or replace any materials, shaD eease. This Limited Warranty shall be consbUed according to the laws of the State of Ohio. SOPREMA SHALL NOT BE IN ANY CASE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, whether arising from breach of contrac~ negligence, breach of warranty, or any other legal theory, including, but not limited to, loss of use of the building or any other equipment, cost of capital, cost of any substitute equipmen~ facilities or services, lost profits, downtime costs, or claims of customers of the owner for such demages. Some states do not allow the exclusion or limitation of incidental or consequential demages, or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. ALL OTHER WARRANTIES ARE HEREBY EXCLUDED.
