I General Description 1
I
Person Hall is an 1-plan, Georgian Revival $tyle masonry building with intersecting gable
roofs. The two end pavilions are high one-story, while the connecting central section
has two stories. the second story being a mechanical room. The building is located in
the center of the older portion of campus, ii'ITlmediately adjacent to McCorkle Place .

The basement/crawlspace of the building i~ unfinished and is devoted exclusively to
piping. The first floor has performance spabes at either end, connected by a central,
double-loaded corridor with offices/practice rooms and toilets. An upper level over the
central wing serves as a mechanical room .
Exterior Design
The exterior of the building is hand-molded brick masonry with sheet metal formed
cornices and wood windows and doors. The windows and doors are round-arched, with
double-hung wood window sash and wood doors. Along both elevations of the central
wing are round-arched blind windows. Adj,cent to the west elevation is a raised terrace
paved with stone. j
Person Hall's roof is decked with cast gyps~m planks. The planks are waterproofed with
a self-adhesive bituminous membrane, topped with red rosin paper. The exposed roof
membrane consists of a standing seam copper roof with barrel-arched vent dormers .
There is no insulation in the roof system. ~utters are copper, half-round, double-roll
type suspended from the roof pans on adju~table brass hangers. The downspouts have
conductor boxes and are round in section. They terminate into cast iron boots that are
connected to the subsurface drainage syst m .
Interior Construction and Finish
Person Hall is classified as a Business ~ccupancy. The type of construction is Ill-B .
-ihe existing interior wall finish is painted g psum wallboard. Flooring throughout the
lower level is glue-down carpet, VCT, or Ia inate. The mechanical room has an
exposed concrete floor. The ceilings in the Recital Hall and Choral Room are dished

plaster with suspended gypsum wallboard/wood soffits. The baseboards, window and
door trim, and windows and doors are of painted wood .
Structural
Person Hall is constructed with common brick load-bearing masonry on the exterior, and
between the two end pavilions and the center hall. The existing 1970s interior structure
of the building has reinforced concrete interior basement foundation walls and steel pipe
columns on the first floor. Both levels have concrete floor slabs. The existing roof
structure of the building is framed with hot-rolled steel trusses with steel channel purlins
and cast gypsum planks for the roof decking .
Plumbing
Domestic water was provided on this project to serve stand-alone humidifiers. Drains
from air handling units were routed from the units to existing floor drains located in the
mezzanine mechanical room .
Mechanical
This project provided a transitional HVAC renovation of Person Hall until an anticipated
more comprehensive renovation/restoration is performed at a future date. An existing
HVAC system installed in the 1970's was found to be exceptionally noisy, and all
conditioned spaces were found to have indoor air quality issues. This project included
the replacement of all air handling units and related above-ceiling ductwork, the
provision of sound attenuating plenums in supply and return air streams between the
Choral Room and Recital Hall, and the mechanical room. The air handling units were
provided with variable frequency drives to permit operation at low flows to provide
reduced cooling capacity and simultaneous dehumidification. The air handling units
were also provided with economizer (free cooling) sequence to permit the ability to take
advantage of outdoor ambient conditions for the cooling of the building without the use of
chilled water. Equipment and materials were provided for positive building
pressurization, de-humidification and humidification, and precise temperature control.
During design it was recognized a desire for the future elimination of the existing
mezzanine mechanical room and raising of all equipment to an attic location. All
equipment and ductwork was located in such a way to permit the future relocation of
HVAC equipment directly upward .
The chilled and heating hot water systems were replaced from the point of entry into the
building to the final users. New pumps and hot/chilled water bridge controls were
provided in accordance with UNC-CH Guidelines .
New DDC temperature controls as provided by Johnson Controls were installed in the
building. The controls were provided with an interface to the existing campus-wide
system .
Valuable instruments and other items were stored in the Recital Hall during construction .
A temporary HVAC system was designed in conjunction with the University to provide
temporary conditioning of the storage space .

Electrical
The existing electrical system was modified as necessary to support the replacement of
the HVAC systems. Most electrical service panels were retained .
A VESDA aspirating-type fire alarm system was installed to monitor conditions in the
Recital Hall. The system will provide earliest warning of smoke and/or fire in the space
while minimizing the visual impact on the historical space. The existing fire alarm
system was upgraded by the University's forces during the project.

The final inspection was made on 7 May, 2007. The guarantee period begins on
7 May 2007, and shall terminate on 7 May 2008 .
The contractors report that final payments have been made to all material
suppliers, employees and subcontractors, and copies of their lien waivers are
attached .
Builder's risk insurance was cancelled as of 7 May 2007 .
The total time for completion as allowed in the contract plus granted time
extensions is 159 days. The actual time required for completion was 273 days,
and the contractor is liable for liquidated damages. The contractor has not been
notified of any proposed assessments of liquidated damages. Copies of my
letter of recommendations as to the amount of liquidated damages are attached .

Re: Fabco Construction Company, Inc., Request for Additional Contract Time
Bids were opened on 25 May 2006. An award recommendation was made on 31 May
2006. The project was awarded by UNC-CH on 21 June 2006. Due to Contractor delays
in getting bonds and insurance certificates required for the contract, the pre-construction
conference was not held until27 July 2006, and the Notice to Proceed was given as of 7
August 2006. Roof demolition did not begin until the third week in September and in-fill
framing and gypsum sheathing were not complete until the first week in December. The
roofers were not able to begin drying-in until early November. Delays in General
Contractor mobilization, beginning roof demolition, and completing the roof infill seriously
delayed the beginning of HVAC installation and the completion of the finished roof .
Although there was rain during the fall, and particularly in September, National Weather
Service statistics indicate that the overall rainfall during the roof construction period was in
line with the average of the previous five years, as stated in the Contract. No contractor
diaries have been provided to indicate otherwise .
Air handlers, piping and ductwork were complete by 9 March 2007, but the variable
frequency drives were delayed and were not installed until the week of 14 March, delaying
start-up for the HVAC units. The delay in getting the proper VFDs and installing them
more than wiped out any delays prior to that time for mylar ductwork liners or the revised
return air arrangement at the Recital Hall.
In regard to the Hot Water Controls, Carter & Burgess first noticed many of the control
elements laid out on the mechanical room floor on 20 September 2006. These were items
installed after the design process had been completed. Carter & Burgess advised that
they would provide a sketch for re-installing the items in the corrected location. Said
sketch was provided to Comfort Engineers on 21 September 2006. On 29 December 2006,
Carter & Burgess received an e-mail from Comfort Engineers regarding the identity of
control devices. The existing devices had been disposed of. Carter & Burgess confirmed

on 3 January 2007 that the devices were required. A change order proposal was
submitted on 1 February 2007. Due to confusion among the designers, the change order
was not prepared unti126 February 2007, and was not approved by UNC-CH until28
March 2007. The hot water controls appear to have been installed by the end of April,
2007. No information has been provided by Comfort as to when the components for the
hot water controls were ordered and when received. There was clearly a delay at the end
of the project caused by lack of hot water controls, but there were also three months at the
end of 2006 when the hot water controls issue could have, and should have, been
resolved .
At the pre-final inspection of 22 March there were other HVAC issues that did not allow for
Owner Acceptance. These items included incomplete BAS controls, no test and balance,
a supply duct connected to a fan inlet over the Recital Hall and a missing supply grille in
the Choral Hall. No hot or chilled water had yet been supplied to the building by the
University, nor had the fire alarm system been installed by the University. As of the 301h of
April, the missing supply grille had still not been installed. Exactly how much the failure of
the University to provide hot and chilled water and to complete the fire alarm system
delayed DOl inspection is not clear. I recommend that the University give Fabco ten days
for miscellaneous delays .
It should be noted that in no case has Fabco Construction requested additional time as
part of a Proposed Change Order for work on Person Hall. All requests for additional time
have come at the end of the project, and have included signed and approved change
orders for which Fabco requested no time when they were executed .

settlement, excessive deflection, deterioration, and
decomposition;
5. faulty construction of parapet walls, copings, chlmneys,
skylights, vents, equipment supports, and other edge conditions
and penetrations of the work;

6. vapor condensation on bottom of roofing; and
7. activity on roofing by others, including construction contractors,
mamtenance personnel, other persons, and animals, whether
authorized or unauthorized by Owner.
b. When work has been damaged by any of foregoing causes, Warranty shall
be null and void until such damage has been repaired by P & R Roofing,
Inc. and until cost and expense thereof have been paid by Owner or by
another responsible party so designated.
c. P & R Roofing, Inc. is responsible to damage to work covered by this
Warranty but is not liable for damages to the building or building contents
resulting from leaks or faults or defects of work.
d. Dming Warranty Period, if Owner allows alteration of work by anyone
other than P & R Roofing, Inc., including cutting, patching, and
mamtenance in connection with penetrations, attachment of other work,
and positioning of anything on roof, this Warranty shall become null and
void on date of said alterations, but only to the extent said alteration affect
work covered by this Warranty. If Owner engages P & R Roofing, Inc. to
perform said alterations, Warranty shall not become null and void unless P
& R Roofing, Inc., before starting said work, shall have notified Owner in
writing, showing reasonable cause for claim, that said alterations would
likely damage or deteriorate work, thereby reasonably justifying a
limitation or termination of this Warranty .
e. During Warranty Period, if original use of roof is changed, this Warranty
shall become null and void on date of said change, but only to the extent
said change affects work covered by this Warranty .
f. Owner shall promptly notify P & R Roofing, Inc. of observed, known, or
suspected leaks, defects, or deterioration and shall afford reasonable
opportunity for P & R Roofing, Inc. to inspect work and to examine
evidence of such leaks, defects, or deterioration.
g. This Warranty is recognized to be the only warranty ofP & R Roofing,
Inc. on said work and shall not operate to restrict or cut off Owner from
other remedies or resources lawfully available to Owner in cases of
roofing failure. Specifically, this Warranty shall not operate to relieve P &
R Roofing, Inc. of responsibility for performance of original work
according to requirements of the Contract Documents, regardless of
whether Contract was a contract directly with Owner or a subcontract with
Owner's General Contractor.

Waiver of Bond Rights. Waive, relinquish. and release any rights it has against any labor, material,
payment, performance, or lien discharge bond pertaining to the foregoing descn"bed Property and the
improvements thereon.
Waiver of Claims. Waive, relinquish, and release any and all claims, causes of action, suits, damages,
judgments, claims and demands of any kind, character, and description, whether known or unknown,
against the Contractor, the Contractor's bonding company, and the Owner, their directors, officers,
principals, general and limited partners, employees, agents, subsidiaries, parent, and related corporations,
successors, and assigns, arising from, pertaining to, or arising out of the :furnishing of the foregoing
descn"bed materials and/or labor, the Project or the Property .
All Parties Paid. Warrant and represent that it has been paid in full all amounts owed for all materials or
labor furnished pursuant to the above-referenced contract and that any and all parties who have supplied
labor or materials to the Undersigned for or in connection with the making of the improvement to the
Property have been paid in full all amounts owed to them as a result of the performance of such labor or
the furnishing of such materials .

sold, assigned, or conveyed such claims to any other party, that the individual executing this instnnnent on

has authorized me to extend the following settlement offer to Fabco in order to resolve this
claim. Sparrow Enterprise, Inc. will accept the sum of$5,951.00, by bank/certified check, if
received from Fabco on or before July 2, 2007. This amount represents the difference between
SparroWs outstanding accollllt balance of $8,055.80, and the amounts clalmed by Fabeo arising
out of repairs to the duct work in the amount of$2,104.80 .
Upon receipt of these certified funds, Sparrow Enterprise will file a dismissal of its
lawsuit against Fabco, thereby concluding the matter in its entirety. You may send the check
directly to me, at the location listed above, and I will then prepare and file the necessary paper
